Golfer Receives
£80,000 Pay-out
A golf insurance company have recently settled a claim of
more than £80,000 from an injured Kent golfer.
The insurers paid out on a 1998 Court of Appeal ruling which
stated that a shout of 'Fore!' does not exonerate golfers
who cause injuries with mis-hit shots.
The case concerned Sheree Cox, a civil servant, and Peter
Nash, a
company director. The incident happened at The London Club,
where both golfers are members, during a Sunday three-ball
competition in September 1996.
After seeing his tee shot disappear into rough, Nash, a 12-handicapper,
hit a provisional, which he duck-hooked. His ball hit Miss
Cox, who plays off 10, on the right temple as she walked towards
the ladies' tee.
She was knocked unconscious and taken by ambulance to Maidstone
General
Hospital. Mr Nash's insurer's settled her claim for damages
(including legal costs) on behalf of Nash.
The
insurer's stated:: "Most claims we deal with are for the loss,
theft or damage of golf equipment, payment of membership fees
or hole-in-one bar bills.
"Nevertheless, the golfing public is largely unaware of the
need for specialist golf insurance, especially as courses
are becoming more and more crowded and our society more litigious.
"Unfortunately, too many golfers believe they are automatically
protected by their household insurance for all their equipment
and public liability needs.
"Our research shows that in the last 11 years a staggering
101,734 golfers suffered injuries requiring hospitalisation,
and in 1998 alone, 7,500 of the 16,464 recorded accidents
involved head injuries to the head! These are statistics of
which all golfers should be aware."
